Home Owners Guide To Foreclosure


You are still the owner of your home.

The mortgage company only has a lien on it.

I am a Realtor whom is a Certified Foreclosure Prevention Consultant  that works closely with the property owners and the mortgage lender to sell homes prior to the foreclosure process.  I negotiate with the lender to accept an amount of money as payment in full for the lien they have on your property.  Mortgage companies are usually glad to have the home sold rather than to go thru the foreclosure process.   My negotiations include delaying the foreclosure and procuring what is called in the real estate business as a “Short Sale”.

One benefit of this process to you is that you can stay in the home until it is sold, paying nothing.  Another benefit is that the sale of the home costs you nothing since the mortgage company will pay the commissions.  Also by not letting your home go to foreclosure sale, you avoid having the default appear against your credit record.   You also avoid the possibility of the lender suing you for a deficiency judgment in the event the sale does not yield enough money, and most importantly, you maximize the chance to actually make some money on the sale, as opposed to losing money.

Obviously, you would rather keep your home and meet your financial obligations.  However, sometimes that is not possible. When it is not possible the next best thing is to take active control of the situation and do what is best for you.

Options for Homeowners:

1.  They can try to refinance to get lower interest rate.

2.  Sell the property and try to still both your credit & the equity you still have in your   

     home; Before it goes into auction.

3.   WORST OPTION-Lose everything-If you don’t sell your home, it will go into sheriff auction.

 

Points You Should Consider:

      Don't worry about late payments on your credit report, it will disappear after 1 year. But If you have a foreclosure on your credit report, you cannot buy another home for 4 years.

In New Jersey, lenders may foreclosure on a mortgage in default by using the judicial foreclosure process.

Judicial Foreclosure

Generally, in judicial foreclosure, a court decrees the amount borrower’s debt and gives him or her a short time to pay.  If the borrower fails to pay within that time, the clerk of the court then advertises the property for sale.

Once the process begins, a foreclosure notice must be: 1) posted in the county office of the county where the property is located; 2) posted on the property in foreclosure; and 3) published in two (2) newspapers in the county.  The lender must also notify the borrower at least ten (10) days prior to the foreclosure sale. 

It is possible for the lender to obtain a deficiency judgment and borrowers have a right to redemption and/or objection within two (10) days after the sale.
